General Terms and Conditions (GTC) of the Vorarlberg Snowboard School JP.SNOW

1. General

Unless explicitly agreed otherwise, these General Terms and Conditions (GTC) apply to all business transactions between the snowboard school JP.SNOW and its customers. The company’s purpose is to operate a one-person ski school that teaches all types of skiing, including alpine skiing, snowboarding, cross-country skiing, telemark, and other specialized disciplines. This includes, in particular, services such as providing instruction in the skills and knowledge of snowboarding (without guaranteeing any specific training success) as well as guiding and accompanying clients while snowboarding.

2. Conclusion of Contract for Offers, Online Price Inquiries, and Prices

Reservations for private lessons can be made online, by telephone, or by fax. Reservations are only considered firmly booked upon written confirmation from JP.SNOW. All offers by JP.SNOW are non-binding. The acceptance of a reservation and the scope of services are determined exclusively by our written order confirmation. Oral or telephone side agreements are only valid if explicitly confirmed in writing by JP.SNOW.

All prices quoted by us are in euros and exempt from VAT in accordance with our small business regulation. Price lists are provided without guarantee. No liability is assumed for printing errors. JP.SNOW does not guarantee the timeliness, accuracy, completeness, or quality of the information provided on the internet. Claims for liability against JP.SNOW for any material or immaterial damages caused by the use or non-use of the presented information or by the use of incorrect and incomplete information are generally excluded, provided that no demonstrably gross negligence or intent exists on the part of JP.SNOW. All offers are non-binding and subject to change. JP.SNOW expressly reserves the right to modify, supplement, delete, or temporarily or permanently cease the publication of parts of the website or the entire offer without prior notice.

3. Payment Terms

For concluded contracts, payment for the service to be provided must be made directly at the snowboard school office, to the snowboard instructor, or to the snowboard guide, unless otherwise agreed. In the event of late payment by the customer, we are entitled to charge default interest of 5% per year, without prejudice to claims for higher interest.

4. General Participation Conditions

The customer must truthfully and comprehensively inform JP.SNOW about their abilities and experience in snowboarding and ensure that their equipment is appropriate for their skill level and the external conditions. They must also provide information on their physical condition, especially any health issues or ailments. Before the lesson begins, the customer is responsible for having their snowboard equipment checked by a professional service provider.

The grouping of participants in snowboard courses is carried out by JP.SNOW. If a participant needs to be reassigned to a different group, they must comply with this decision. Otherwise, JP.SNOW is entitled to terminate the contract. Participants must follow the instructions given by JP.SNOW. Disregarding a warning entitles JP.SNOW to immediate contract termination.

Participation in JP.SNOW services under the influence of alcohol or drugs entitles JP.SNOW to immediate contract termination. In such cases, the customer has no right to a refund of the paid fees.

5. Liability Regulations

JP.SNOW is not liable—except in the case of personal injury—for damages unless they are caused by intentional or grossly negligent behavior of JP.SNOW, its legal representatives, or its assistants, and the damage-causing behavior is not related to contractual obligations of JP.SNOW. This exclusion of liability does not apply to completely unforeseeable or atypical damages that the customer could not have anticipated.

JP.SNOW assumes no liability for damages that the customer inflicts upon themselves or others during the agreed service. The services provided by JP.SNOW take place exclusively outdoors, on ski slopes, or in open terrain under sometimes difficult to very difficult conditions. Adverse weather conditions such as rain, snow, or fog can further complicate conditions.

The customer must truthfully and fully inform JP.SNOW about their abilities and experience in snow sports, as well as their physical fitness, particularly their health condition and any ailments. JP.SNOW’s services may require high levels of physical fitness and technical skill. Each customer is therefore advised to participate only with properly maintained sports equipment and the prescribed safety gear and to realistically assess their own abilities.

Customers are advised that not wearing a helmet may contribute to shared liability in case of injury. It is therefore recommended that customers wear a helmet and any other safety equipment recommended for the booked service (e.g., avalanche transceivers for off-piste riding).

6. Warranty

Customers must report any complaints immediately on-site at the office to enable corrective measures. Failure to report complaints in a timely manner results in the loss of any entitlement to a price reduction.

7. Cancellation by the Customer

The customer is entitled to cancel the contract free of charge up to 14 days before the booked service begins. After this period, cancellation by the customer is no longer possible, and JP.SNOW retains the full payment claim for the agreed total price, regardless of whether the customer fully or partially utilizes the booked service (e.g., due to illness, accident, bad weather, etc.).

The aforementioned deadlines also apply to partial cancellations of the booked service. The time at which JP.SNOW receives the cancellation notice is decisive.

If the customer cancels only a single day or certain days within a booked period or does not show up (“no show”), JP.SNOW has the right to withdraw from the contract regarding the remaining days after the canceled or unused days. In this case, JP.SNOW forfeits its claim to payment for the remaining days that have been canceled.

To exercise its right of cancellation, JP.SNOW must notify the customer by email or telephone.

If a service has been used at least partially on a given day (e.g., in case of an accident or illness during the course), that day will be fully charged. This also applies if the customer only partially uses the agreed course (e.g., 3 out of 4 hours). In such cases, the full daily rate will be charged.

8. Cancellation by JP.SNOW

If weather conditions make it unsafe to conduct the booked service, JP.SNOW reserves the right to postpone or cancel the service. In the event of cancellation, JP.SNOW will refund the paid fee within 14 days of cancellation.

9. Safety

Course participants are explicitly advised that all participants are required to wear a certified ski or snowboard helmet while snowboarding.

11. Jurisdiction

All disputes arising from this contract shall be exclusively settled by the competent court at the registered office of JP.SNOW in Innsbruck.

12. Governing Law

Austrian law applies.

13. Legal Validity

If individual provisions of these terms and conditions are invalid, this does not affect the validity of the remaining provisions or the entire legal transaction.
